Use of the Manual constitutes acceptance of the terms associated with its use, including an understanding that this manual is provided with no warranties expressed or implied by the Concrete Sawing and Drilling Association of Australia (CSDAA).
By purchasing a Premium Membership with the CSDAA I acknowledge that:
• I am a financial member of the CSDAA;
• I have read the terms of the Member Licence (below) which I have accepted; and
• The Terms and Conditions constitute the entire agreement between you and the CSDAA.
In these Terms:
‘WHS Management Plan Manual’or ‘CSDAA Health and Safety Management Plan Manual’ or ‘WHS Management Plan and Associated Documents’ means anonline operational manual and associated documents.‘The Manual’ isowned and operated by the CSDAA..
2. Acceptance of Terms
By using the CSDAA online manual you agree that:
a. You agree to indemnify and keep indemnified the CSDAA from all actions, claims, costs (including legal costs and expenses) losses, damages, liabilities, or demands suffered or incurred by the CSDAAand any person arising out of your failure to comply with these terms and conditions.
b. Use of the manual is at your sole risk.
4. Intellectual Property
The CSDAA owns all proprietary and intellectual property rights in the online manual and other material underlying and forming part of the online manual. You agree not to publish or create derivative works from any part of the manual and only use the manual in the manner in which it was designed. The CSDAA vigorously defends its intellectual property rights.
Personal information received by us will be kept confidential at all times. We will not release or disclose this information to other parties without your consent (unless required to do so by law).
The CSDAA provides users with access to the online Manual. You understand and agree that the manual is provided and that the CSDAA assumes no responsibility for the timeliness, deletion, or failure to store any user communications or personalisation settings.In order to use the manual, you must obtain a Premium Membership to access the information. You will be provided with an ID number/login to access the online Manual. When logging in for the first time you will need to complete the agreement terms and condition, then you will be asked to personalise the manual for your business. Once you have entered the business details you will not be able to change this information, as it will be permanently embedded into your copy of the manual.
You agree to indemnify and hold the CSDAA, and its executive members, members, executive officer, affiliates or other partners, harmless from any claim, disputes or demand, including reasonable legal fees, made by any third party due to or arising out of content you submit, post to or transmit, your use of the manualand material, links provided on the web site, your violation of the terms, or your violation of any rights of another including but not limited to, direct or consequential breaches of copyright, trademark or other intellectual property rights, or contravention of any local, national, or international restrictions on the publication or transmission of content. Indemnification shall include any and all fees and costs associated with responding or answering any claims or assertions against the CSDAA including, but not limited to: internal costs, agency fees, legal and experts, witnesses, document production and management, correspondence, travel, filing fees, employee pay and reimbursement.
8. No Resale of Manual
The CSDAA grants you a limited license to access and make personal use of this manual and not to download (other than allowable pages) or modify (as allowable) any portion of it, except where express permission has been provided. This license does not include any resale or unlawful commercial use of its contents. Themanual or any portion of the manual may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without express written consent from the CSDAA Executive. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form). Any unauthorized actions will terminate the permission or license granted by the CSDAA.
9. Modifications/Update to Manual
The CSDAA reserves the right at any time and from time to time to modify the Manual (or any part thereof) with or without notice. You agree that the CSDAA shall not be liable to you or to any third party for any modification of the Manual.The CSDAA reserves the right to update, edit, change, delete, or otherwise alter any or all of the content of the online Manual, as it sees fit, without notice or regard to the effect on any other party.
10. Availability and Access
You agree that no liability will attach to the CSDAA if the online manual access becomes unavailable or inaccessible for any reason whatsoever. You agree that the risks of relying on access to the online manual are your sole responsibility.
Access to the manual will be withdrawn should annual membership fees be more than 14 days overdue. Access to the manual is based on membership type and financialstatus. Therefore if members are more than 14 days overdue all access will be terminated until payment is received. Once payment has been received, allow 24-48 hours for access to be provided.
12. Proprietary Rights
The User acknowledges and agrees that the online Manual contains proprietary information that is protected by applicable intellectual property and other laws.
13. Trademark and Copyright Information
The CSDAA logo is a trademark of the Concrete Sawing and Drilling Association of Australia. CSDAA trademarks cannot be used without prior permission, properly authorised in writing, or in any manner that disparages or discredits the CSDAA. All contents included in the Manual such as text, graphics, logos, button, icons, and images are the property of the CSDAA and are protected by International Copyright Law. Information on the Site may not be reproduced in whole or in part for general publication or commercial purposes without the permission of the CSDAA.All other trademarks not owned by CSDAA that appear on web site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by CSDAA.
You shall not package, sell, duplicate, appropriate, copy, or exploit any portion of this online Manualor any part of it for any purpose, except for your own intended use. This includes downloading and printingtemplates and forms for your own use. The CSDAA retains all rights, including copyrights to themanual,and associated documents(templates and forms). The user may print for personal use only, but not for mass distribution outside tenders, quotes, and contract compliance. The CSDAA retains all rights including copyrights to all web pages and site content. You agree that mere objection by the CSDAA shall suffice for finding a violation of this section.
The Manual is provided to qualified members of the CSDAA and is not represented as constituting legal advice. Further professional advice from a qualified expert in the relevant area is essential before any action is taken or reliance is made on any of the contents of the publication. Although every effort has been made to ensure that the contents of this publication are accurate at the time of publishing. The CSDAA does not warrant the accuracy or otherwise of any statements made by any person. None of the publisher, authors, consultants, editors shall have any responsibility for any error or omission, and the CSDAA for itself and the authors, consultants and editors hereby disclaims all liability to any person in respect of any reliance by any person in whole or part on the contents of the publication.
16. Laws, Regulations, and Rules
The Terms and Conditions shall be governed by the laws of the State of Victoria, Australia without regard to its conflict of law provisions. The CSDAA makes every reasonable effort to comply with the laws, regulations, and rules applicable within the Australia and does not warrant or infer any compliance with other countries’ provisions.
17. Force Majeure
The CSDAA has no liability for any lack of performance, unavailability or failure of the manual or the web site. We do not guarantee that use of our manual will be virus and error free.
18. No Waiver
Any failure on the part of the CSDAA to enforce any of the terms of this Agreement is not a waiver of this Agreement or any portion of it. You agree that these terms shall be deemed in full effect even where the CSDAA does not enforce the terms, whether by election or by oversight.
